There are hosts who are also okay with letting smokers stay, as long as they smoke outside. But for most hosts who have a no smoking policy, they will actually mean no smokers. And this needs to be made very clear: No Smoking Inside.
If a property declares itself smoke free it generally means, at a minimum, that you will not be permitted to smoke anywhere inside the building, on a balcony or within 3 metres outside of the building. Many properties have more stringent rules and will include all of their grounds as well.
A smokefree home is a home where use of any tobacco products (such as manufactured or roll-your-own cigarettes, cigars, waterpipes and heated tobacco products) and electronic cigarettes is not allowed anywhere (including balconies and terraces).
Landlords in Ontario have the right to ban smoking in all or part of a building, including indoor units and outdoor patios and balconies. While they cannot change current tenancy agreements, landlords can include a non-smoking clause in new agreements.
A no smoking sign in a place is a notice to say that smoking is forbidden in that place. Smoking is allowed in areas that do not display a no smoking sign. There are no smoking signs in all the no-smoking rooms.
Is a smoke-free policy legal for rental properties? Yes. It is perfectly legal for landlords to make their buildings smoke-free. Landlords have the right to designate all or part of a building as smoke-free, including individual units, balconies and the entire property.
Example addendum term: The Tenant agrees to the Cleaning Schedule as set out in the Cleaning Schedule attached to this Residential Tenancy Agreement and agrees to the deductions from their damage deposit should they fail to clean the unit thoroughly.
