The three types of patents are utility patents, design patents, and plant patents. Utility patents are issued for inventions that are novel and useful. Design patents protect the design or image of a product. Plant patents are issued to applicants for plants that can reproduce.
Examples of manufactured articles protected by design patents are a design for the sole of running shoes, a design for sterling silver tableware, and a design for a water fountain. There are strict requirements for granting utility patents and design patents.
No, design patents do not protect pictures, images, graphic designs, patterns or any other 2-dimensional visual imagery in the abstract.
Thus, designing around a patent is not only permitted bylaws, it is encouraged. The process of designing around a patent begins with a study of the patent and its claims.
To design around a utility patent, the focus should be on the independent claims. Each and every independent claim must be thoroughly analyzed with the goal of omitting at least one key feature (aka claim element or claim limitation) in the design around product. The more omissions, the better.
A patent is an exclusive right granted for an invention, which is a product or a process that provides, in general, a new way of doing something, or offers a new technical solution to a problem. To get a patent, technical information about the invention must be disclosed to the public in a patent application.
If you make a product with a unique look, a design patent may be worth considering. In addition to being ornamental, your design must be novel and not obvious to those in your field, meaning it must be truly innovative and not a logical extension of a pre-existing design.
A copyright is not the only way to protect your ideas and designs. If you have created a name and logo that appear on every pattern you make, you can file for a trademark to protect them. Trademarks apply to goods or services that are being sold.
To register a copyright for your graphic, you can apply online with the U.S. Copyright Office at Copyright.gov. There are 14 acceptable image file types including, BMP, JPG, GIF, PDF, PNG, PSD and TIF. Compressed files are also accepted and include CAB, RAR and ZIP files.
There are five requirements that must be met to obtain a patent: patentable subject matter, utility, novelty, nonobviousness and enablement.
