In general, a gift is made when it is delivered to the charity. In the simplest case, when a donor hands a check directly to the charitys representative, thats delivery and hence thats the date of the gift.
The legal date of gift for all QCDs, whether outright or used to establish a life income gift, is the date they leave the donors account. For checks received directly from the IRA custodian, charities can use the date the check is issued.
The gift date (i.e., the date a gift of securities is considered complete) is the date that the securities pass unconditionally from your control. If the securities are transferred to Barnards account at JPMorgan Chase, the gift date is the date the securities are received in our account.
For a donor who mails a check to a charity that properly clears the bank in due course, the contribution date is the postmark date on the transmittal envelope. The postmark date of the donation becomes critical around the beginning and end of a calendar year.
For any contribution of $250 or more (including contributions of cash or property), you must obtain and keep in your records a contemporaneous written acknowledgment from the qualified organization indicating the amount of the cash and a description of any property other than cash contributed.
If handed to you in person, the date of gift is that date or as of the date on the check, whichever is later. If mailed to you through the U.S. Mail, the gift is made as of the postmark date. Whoever is charged with opening the mail should understand the importance of keeping or scanning the envelope.
For cash and checks, the date of mailing if mailed through the United States mail or the date of delivery to the charitable organization if sent via a private delivery service (such as FedEx or UPS). For credit card payments, the date the credit card company charges the donors credit card.
