To change an agreement or order, you need to provide information to the court about new circumstances. There must be something new that has happened for the court to revise the original agreement or order. If the agreement or order was made ing to the Divorce Act, you will need to apply to the Supreme Court.
If youre not sure if you should change your agreement, you can ask for help. If you cant agree about changing the agreement and youve tried mediation, you might have to go court. The court can set aside (cancel) part of it, or even all of it, and replace it with a court order.
Simply put, until you get divorced, your old will remains valid unless you create a new will after your separation. And so, if your ex is named your executor or a beneficiary of your estate, those designations survive your separation until you formalize you divorce.
