The simple answer is not really. Courts (judges) have the ultimate say as to whether child support can be varied or waived, and they will only do so for specific reasons and where they are satisfied that reasonable arrangements for the financial support of the child(ren) have been put in place.
How can unpaid child support be collected? Try calling DCSS (Department of Child Support Services) toll-free at 1-866-901-3212 . They may be able to help with collecting the unpaid child support (called arrears).
If the support payer has one child with one parent and two children with another parent, then the support payer pays the full table amount for one child to the first parent and pays the full table amount for two children to the second parent.
Penalties for Failing to Pay Child Support One of the first penalties youll suffer is wage garnishment. The Family Responsibility Office is empowered to take the money right out of your paycheck. The FRO is also empowered to charge additional fines and fees for failing to pay support.
A paying parent is required to make regular payments to the recipient parent, and failure to do so can result in legal consequences. Child support continues until the child docHubes the age of majority, which is 18 in Ontario, or longer if the child is still in school or has a disability.
There may be other enforcement measures under provincial or territorial laws. For example, a court could order you to pay a fine and all the legal costs of enforcing the support order or written agreement. A court may even order you to serve time in jail if you do not pay support.
If you agree to change the amount of support If you and the other parent agree that you want to change a child support order, you will have to apply to make the change in the same court that made the original order. This is called bringing a motion to change.
Generally, changes in the recipient spouses living conditions, such as remarriage or new employment, will not result in a change in the Table amount of child support. This is because the payors obligation is to the child directly: children have a right to benefit from their parents financial means.
