There are only two sure-fire ways to know you passed the check: for the potential employer or hiring manager to confirm that you passed and/or for them to extend a job offer (that is not contingent on finalizing the background screening).
There are times its legal for an employer to deny you a job or a promotion based on information in your background report.
There are laws limiting the employers ability to make hiring decisions based on a past record, at the federal, state and local level. At the federal level, the Civil Rights Act of 1964 states that employers cant just reject you out of hand because of your record.
There are many reasons why a candidate may fail a background check, from criminal history to discrepancies in employment or education history, or an unsafe driving record or failed drug test.
Criminal record searches are the most common type of background check, but there are many to choose from. Failing to conduct background checks could result in damage to your company brand.
Here are four steps to follow if and when you decide to reject a candidate due to a failed background check: Follow Your Hiring Policy. Send a Pre-Adverse Action Notice. Give the Candidate the Opportunity to Respond. Make a Decision.
Its best to notify the employer straightaway and provide evidence to prove the information is wrong, then, together, you can move forward to get the background check results corrected.
A failed background check means the results of the background screening report returned alerts on a job candidate, such as a criminal conviction, a suspended drivers license, or a positive drug test.
