Californias Fair Employment and Housing Act (FEHA) protects applicants and workers from age discrimination in the hiring process. Under FEHA, it is illegal for an employer with five or more employees to treat an applicant or employee adversely because of their age.
Federal law does not prohibit employers from asking employees or job applicants about their age, including in application materials and background checks. However, asking about a persons age could discourage older workers from applying to jobs because of fear of possible discrimination.
Can my employer ask about my age? Federal law does not prohibit employers from asking an applicants age or date of birth.
That being said, it can be dangerous and counterproductive to place too much emphasis on previous experience. Specifying the number of years experience in a Job Ad can expose your company or organisation to claims of age discrimination.
Ageism in job adverts When advertising a job role, employers cant include age limits, and should avoid using words which could suggest they are looking for applicants from a particular age group for example, by using terms such as 10 years experience, enthusiastic young people or recent graduates.
In some cases, listing age requirements is actually a necessity for a job. If there are laws governing who can perform certain types of tasks or work certain kinds of jobs, then an employer can list an age requirement along with all of the other requirements of a job.
The Age Discrimination in Employment Act (ADEA) was established in 1967. It states that any form of age discrimination during employment, hiring, firing or promotion is prohibited. One important side note companies with less than 20 employees are exempted from ADEA.
An applicants older age signals to recruiters that the applicant has lower technological skills, flexibility, and trainability levels.
