In Texas, if the employers written policy or written agreement with an employee provides paid time off, the accrued but unused PTO or vacation is considered wages and cannot be forfeited (see Drafting Notes, Carryover and Termination of Employment).
However, your job may be protected under the federal Family and Medical Leave Act (FMLA) or the New Jersey Family Leave Act (NJFLA), which require covered employers to provide their employees with unpaid, job-protected leave for up to 12 weeks.
