The general rule for persons seeking DMH medical records of a deceased family member is that a court order must be obtained that requires DMH to release specified records or a court appointed Executor or Administrator of a deceased persons estate may sign an authorization to release records of the deceased person
The HIPAA Privacy Rule applies to the individually identifiable health information of a decedent for 50 years following the date of death of the individual.
Youll need to ask your GP surgery for online access to your full record, or youll only see your medicines and allergies. Some services and apps are only available in certain areas.
GPs and specialists will not release any information unless their patient has given permission for the information to be shared. This is called giving consent, which is a legal need to get access to health details; remember that the employee cannot be forced to give consent.
Who can get access to a deceased patients records? The beneficiary or personal representative of a deceased patient has a full right of access to the deceased persons medical records under the same requirements that would apply to requests from the patient himself or herself. (Health Safety Code 123110, 123105(e).)
The law does not give any other person the right to obtain access to a deceased patients records. Legal documentation must be provided to prove one is the personal representative of a deceased patient.
Your private GP does not have any access to your NHS notes: if you are able to remember and give a clear account of your medical history to date that is rarely a problem but if your history is complex then your private GP may ask you to obtain a copy of your NHS records, at your won expense.
