Can I legally text message my customers?

While it was initially designed to protect consumer privacy and regulate telemarketing calls, it has since been updated to include SMS texts. Under the TCPA, marketers must receive express written consent before sending promotional messages to their customers.

What qualifies as SMS consent?

SMS consent refers to whether someone is opted in (i.e., if they have agreed to receive marketing text messages from your brand).

Is an agreement through text message legally binding?

The answer is YES assuming certain elements are met. Courts that have been faced with this question have found that agreements entered into via text messages are enforceable borrowing from basic contract formation principles and the reasoning applied to email messages.

How do you ask for SMS consent?

To obtain someones express consent for SMS marketing, you must clearly state that they are signing up for marketing messages, and cant include this permission as part of your privacy policy or other small print. You also cannot use pre-checked boxes to make opting in the default option.
