- If youve ever been written up on the job, you know that the write-up is a sign that things are not going well. While some write-ups are legitimate and are sincerely meant to help you improve, others are completely bogus and simply created to justify firing you. So from a legal perspective, how should you respond to a written warning at work? Is there a right way? Is there a wrong way? The answer is yes and this video will give you 12 recommendations on how to respond to a write-up. (light upbeat music) My name is Branigan Robertson and Im an employment attorney. The 12 recommendations that Im going to make in this video will help you respond to a write-up so that you can, number one, minimize the risk of being fired and number two, legally protect yourself in case the company fires you in the future. When youre given a reprimand or a disciplinary warning, dont refuse to sign it because you think not signing it means you dont agree with it. Only a rebuttal says you dont agree with the reprimand. Your signature generally means that you received the reprimand. Reprimands and disciplinary actions are confidential.
A letter of reprimand is an official document that can be issued by an employer to an employee for misconduct or unsatisfactory performance. It serves as a formal warning and is used to inform the employee that their actions are not acceptable and must be corrected.
End the letter on a positive note. This can be done by expressing belief the person will fix the problem. Have the employee sign the letter as evidence the situation was discussed. It then will serve as part of a written record if further action is necessary.
You are not required to sign a warning letter and you should certainly not do so if you consider the warning to be unjust or unreasonable.
If the employee still opts not to sign, an HR professional and witness can document receipt with their own signatures. They may later be called on to testify that the discipline had been presented to the worker.

An employee will have to sign a write-up if theyre given a warning at work, though its not necessarily required of all employees (the employer can decide whether or not they find it necessary to have a signature).
A reprimand is an official warning a manager or supervisor gives a worker in a bid to change unwanted behavior, including poor conduct and performance. When a written warning is issued, it usually indicates prior verbal warnings and other informal approaches have failed to get them back on track.
