Every time you fax a document containing PHI, you are required by HIPAA to use a fax disclaimer with the approved statement warning against unauthorized access. This document informs the receiver that incoming faxes contain personal information that is not to be distributed or disclosed without permission.
Follow these steps to send a fax from your computer: Create a new fax. Compose an email with a message and a cover letter and attach the files to it. Address it to the desired recipient fax number along with the required code. Send the fax and have your documents delivered to the targeted fax machine.
Patient information should only be faxed to fulfill a treatment, payment or healthcare operations obligation or a specifically authorized request (see COMP. 103 Use and Disclosure of Protected Health Information).
Online fax services offer a safe and convenient way to send personal information and sensitive documents. When you send a fax through an online platform like eFax, your document is encrypted in transit to protect any sensitive information that it might contain.
When sending a fax, include a cover sheet indicating the date and time sent; the recipients name and fax number; and the senders name, organization and phone number. The fax cover sheet should NEVER include a patients name or any other PHI. 2. Include a privacy statement in the fax cover sheet.
In general, using a regular paper-to-paper fax to send or receive reimbursement information will not, by itself, make a dental practice a HIPAA covered entity. However, a dental practice can become a HIPAA covered entity if it conducts a HIPAA standard transaction using a computerized or digital fax.
