The U.S. Patent and Trademark Office (USPTO) provides several accelerated programs for patent prosecution. The Track One program, which requires a $4,200 fee, allows expedited examination of a new or pending patent application with a goal of docHubing final disposition of the application within 12 months.
One misconception is that, because of its revised guidance, the USPTO now accepts signatures, as if a signature was monolithic. But there are many ways can be used to create an e-signature, and only some comply with the guidance.
The Electronic Signatures in Global and National Commerce Act, otherwise known as the E-Sign Act, states that electronic signatures shouldnt be considered invalid simply because theyre electronic. In other words, e-signatures are completely legal and binding. They can hold up in court.
1.4(d)(1)(3) govern the three acceptable forms of signatures for papers submitted to the USPTO: (i) handwritten signatures, (ii) S-signatures (e.g., /name/), and (iii) graphic representations of signatures.
Mail via U.S. Postal Service (USPS) to: Commissioner for Patents, P.O. Box 1450, Alexandria, VA 22313-1450. You must use this address to receive the benefit of a certificate of mailing or Express Mail.
eSignatures are valid and legally binding across the globe and in use in 188 countries around the world.
Although electronically signed patent assignments are acceptable for U.S.-filed patent applications, it is recommended to obtain wet signatures from all parties for patent assignments if there is a chance of filing the patent application internationally.
Submit your application online: Use EFS-Web, the USPTOs electronic filing system for patent applications, to submit Utility patent applications, Provisional applications and many other types of Office correspondence to the USPTO via the Internet.
