Patient information should only be faxed to fulfill a treatment, payment or healthcare operations obligation or a specifically authorized request (see COMP. 103 Use and Disclosure of Protected Health Information).
When sending a fax, include a cover sheet indicating the date and time sent; the recipients name and fax number; and the senders name, organization and phone number. The fax cover sheet should NEVER include a patients name or any other PHI. 2. Include a privacy statement in the fax cover sheet.
Every time you fax a document containing PHI, you are required by HIPAA to use a fax disclaimer with the approved statement warning against unauthorized access.
