Under Floridas laws, those who work on your property or provide materials and are not paid have a right to enforce their claim for payment against your property. This claim is known as a construction lien.
In such cases, owners can seek to bond off a mechanics lien. In plain terms, this means an owner can seek to substitute a surety bond for the underlying property in a mechanics lien claim. Basically, the surety bond replaces the property as security for the claim.
**In Texas, the prime contractor must have a written contract with the owner(s) in order for anyone on the project (contractors, subs, suppliers, etc.) to file a mechanics lien against residential homestead projects.
Prior to filing a lien, a lienor who does not have a direct contract with the owner, must serve the owner with a Notice to Owner. The Notice to Owner must state the lienors name and address, and a description of the real property and the nature of the services or materials being furnished.
As mentioned before, property owners can cancel a lien by filing a complaint that requires the contractor to show cause why their claim shouldnt be enforced or canceled. If the claimant fails to respond properly, the lien will be removed via court action.
Lien waivers are generally required to be signed by the claimant or the claimants agent. In the case of an individual lien claimant or project participant, it is clear that the individual can sign his/her own lien waiver, or could appoint an agent (like an attorney) to sign for him/her.
A lien right may be waived only to the extent of labor, services, or materials furnished. Any waiver of a right to claim a lien that is made in advance is unenforceable.
