Real Property Law 227-a(1). Written notice must include: Termination date: The law says, the termination date must be effective no earlier than thirty days after the date on which the next rental payment is due (after the notice is delivered).
If your apartment is rent stabilized, you have the right to a lease renewal. The owner must give written notice of renewal by mail or personal delivery not more than 150 days and not less than 90 days before the existing lease expires.
A 60-day notice is required for tenants who have lived in an apartment for more than one year, but less than two years, or have a lease of at least one year, but less than two years. Tenants who have lived in a unit for more than two years, or have a lease of at least two years, must get a 90-day notice.
1 months notice if your tenancy runs from month to month. If your rental period runs for longer than a month, you need to give the same amount of notice as your rental period. For example, if you pay rent every 3 months, youll need to give your landlord 3 months notice.
Landlords are required to provide notice to tenants if they intend to raise rent more than five percent or if they do not intend to renew the lease. The landlord must provide such notice at least: 30 days in advance of renewal if a tenant has lived in the apartment less than one year and has less than a 12-month lease.
A landlord can simply give you a written notice to move, allowing you 30 to 90 days, as required by New York law, and specifying the date on which your tenancy will end.
A landlord must allow the tenant to renew the lease unless the landlord has good cause for an eviction under the Anti-Eviction Act. (This does not apply to two or three-family owner occupied dwellings, motels, hotels, transients or seasonal tenants).
In New York 5 Page 9 City, 30 days notice is required, rather than one month. Landlords do not need to explain why the tenancy is being terminated, they only need to provide notice that it is, and that refusal to vacate will lead to eviction proceedings.
