These include: Living Will. A living will is a written document that specifies what medical treatment you would or would not want in the event you are in a terminal condition or a persistent vegetative state. Power of Attorney. Health Care Instructions.
The AHCD allows you to make specific written instructions for your future health care in the event of any situation in which you can no longer speak for yourself. The AHCD replaces the Natural Death Act and is now recognized as the legal format for a living will in the state of California.
In California, you dont need to have your will docHubd to make it valid. In most states, you can use a notary to make your will self-proving. When a will is self-proving, the court can accept your will without needing to contact your witnesses to validate it. This can speed up the probate process.
An advance health care directive lets your physician, family and friends know your health care preferences, including the types of special treatment you want or dont want at the end of life, your desire for diagnostic testing, surgical procedures, cardiopulmonary resuscitation and organ donation.
Advance care planning is not the same as an advance directive. Advance directives often include explicit instructions to consent or withhold consent to treatment in specific circumstances. They may also serve to formally assign a substitute decision-maker in the event the patient becomes incapacitated.
Sign Your California Advance Directive in Front of Two Witnesses or a Notary Public. After you create your advance directive, you must sign your document and have it either signed by two witnesses or docHubd. If you choose to have the document witnessed, neither of your witnesses may be: your health care agent.
Does an advance health care directive need to be docHubd in California? No in California, you dont need to have your AHCD docHubd to make it valid. However, if you prefer, you can have your document docHubd instead of having two witnesses sign.
The purpose of a living will is to give exact instructions on what type of medicine or medical care you wish to accept or decline, while an advance directive offers much more information and is capable of being more comprehensive.
