Your landlord can only evict you in specific situations and must give you written notice using the proper form provided by the Landlord and Tenant Board ( LTB ), an independent tribunal with the authority to resolve residential tenancy disputes in Ontario. The form must give the reason for eviction.
The landlord should talk to the tenant to confirm the moving date. If the tenant doesnt dispute the notice and does not leave by 1 p.m. on the effective date, then the landlord can apply for an Order of Possession a legal document from an arbitrator that orders the tenant to leave.
Average Length of Evicting a Tenant in Ontario Overall, the process can take 85 - 138 days after providing the tenant with an eviction notice. However, it can take up to 168 days if you need to remove the tenant forcefully.
All notices must: be in writing. give the address of the residential premises. be signed by the landlord or the landlords agent. set out the rent that is due and any additional rent that may become due during the notice period. state the reasons for the eviction. state the date the tenancy ends.
You can file this application online through the Tribunals Ontario Portal. Application must be filed no later than 30 days after the termination date in the notice. Tenant can dispute the application at the hearing.
In Alberta, an eviction can take 24 hours (if the tenant threatens the landlord) but is usually done in 14-28 days.
Doing it Right A landlord must serve the Two Month Notice to End Tenancy so that its received: At least two months before the effective date of the notice, and. Before the day that rent is due.
If a tenant fails to do any of these things, as a landlord, you have a right to end their tenancy. Its difficult, especially if youre a first-time landlord, but sometimes necessary. The Alberta landlord-tenant law is clear on the process that must be followed when evicting tenants.
