Faxed copies of documents are neither a copy of the original nor the original itself. As such, it is not entirely certain whether faxed documents are legally binding or not. Fax is short for facsimile, meaning an electronically reproduced image of a document transmitted over phone lines from the sender to a recipient.
Documents sent by fax are considered legally binding, especially if they are signed by a physical or digital signature. E-mails, on the other hand, are not always legally binding.
To send the email to a fax send to an email address that is the fax number @ theFaxProviderDomain.com. For example, if the fax number to send to is +1 (212) 555-5555, and the online fax service is Nextiva, the email to send to is 12125555555@nextivafax.com.
Faxing is becoming a dated form of communication, but many businesses and organizations still use it to send and receive official documents and contracts. Although hard copies and fax machines can be bulky, faxing is nonetheless fast and reliable.
A faxed signature is legally recognised as valid and is often used to confirm or approve many business and financial deals. If a contractual agreement is broken, and there is a denial that any agreement took place, a fax of the original signed document is deemed to be sufficient evidence in court.
In addition, faxed documents presented for a traditional, wet-ink notarial act must bear the signers original, wet-ink signature, as follows: Document was first faxed, then wet-ink signed by the signerit bears the signers original signature.
Documents sent by fax are considered legally binding, especially if they are signed by a physical or digital signature. E-mails, on the other hand, are not always legally binding.
