hi im ian richardson and im one of the attorneys here at van attorneys today im going to be talking about demand letters and whether you should send one or not the first question that i get is what is a demand letter and really its exactly what it sounds like its a letter that we send on our clients behalf demanding that some other party do something we can be asking the other party to pay money we can be asking another party to stop doing something it really just depends on the situation there are certainly pros and cons associated with sending a demand letter the pros are that theyre inexpensive and perhaps the biggest pro associated with the demand letter is that in certain cases its required by statute that you send a demand to the other party inviting them to pay the balance due to you before you enforce an attorneys fees provision in your contract so in that case we really have no choice but its important to send a demand letter its also a beneficial practice because i

Using abusive or threatening language will not work in your favor not only will it make the defendant less likely to want to settle your claim, it could even cause damage to your actual case. Beyond that, you should never include dishonest or misleading details in your demand letter.
A formal demand letter should be typed and sent on paper, rather than using email or sending a handwritten note, neither of which provide the same degree of seriousness and gravity.
Can a demand letter be sent by email? Yes. However, if you decide to send your letter through regular USPS mail, consider how you will prove that your intended recipient did indeed get the letter from you demanding payment.
Use certified mail. Send the demand letter via certified mail with a return receipt requested. If you do end up in small claims court, you can use the return receipt to counter any claim that your opponent didnt receive the demand letter.
