The writ of execution expires 180 days after the issuance. Garnishment is the method of levy in which the Sheriff serves a copy of the writ, notice of levy and memorandum of garnishee on the financial institution.
Once a court has established that there is a judgment against an individual, a writ of execution is filed to take that individuals property to pay off the debt attached to the judgment. Then the property itself must be taken.
After a judgment of possession is rendered by the court, the judge may then issue a writ of execution to begin the transfer of property. The judgment for possession states the plaintiff has a right to the property; the writ of execution actually begins the transfer process from a judgment debtor to a plaintiff.
Collecting the Judgment 30 days after the debtor was served you can obtain a Writ of Execution (EJ-130). If the debtor does not file a motion to vacate the judgment in those 30 days, then your California judgment is finalized and you can begin collecting.
The affidavit contains sworn statements attesting that the testator signed their will freely and without any coercion. The testator and the two (2) witnesses must sign the affidavit in the presence of a notary public who will, in turn, provide their certification.

To obtain a Writ of Execution, follow these steps: Complete form CV-24, Affidavit and Request for Issuance of Writ of Execution. Complete form CV-23, Writ of Execution. Each form must be filled out as set forth below: You must provide the date the judgment was entered on the docket.
