Most non-compete contracts prohibit competitive activity by the ex-employee within a certain number of miles of the employers business. The typical language prohibits competitive activity within a 15 to 25 mile radius of the employers business.

If the clause in question prevents competition, its unlikely to hold up in court. Courts are reluctant to enforce such provisions, and will only do so in exceptional circumstances. If, on the other hand, the clause only prevents solicitation, its enforceability is more likely but by no means certain.
A non-compete clause or covenant not to compete (CNC), is a term used in contract law under which one party (usually an employee) agrees not to pursue a similar profession or trade in competition against another party (usually the employer).
The ESA does not prohibit non-compete agreements that were entered into before October 25, 2021. However, employees may have greater rights under the common law.
