In the State of Georgia, the instrument used to secure a debt on property is called a Deed to Secure Debt or Security Deed. Under Georgia law, the lender is deeded the property, but in a lesser form of a deed that becomes activated if the borrower defaults in some way.
Once a deed has been recorded by the County Clerks Office, copies of the deed may be requested if the original deed has been misplaced. Plain copies can be found by using the Official Public Records Search and selecting Land Records. A certified copy may be purchased through request either in person or by mail.
You may review property ownership records by visiting the clerk of court and requesting a copy of the deed for the property. You will likely be charged a fee to obtain a copy of the deed. You may also review the county tax assessors website to obtain this information for free.
You can access all recorded deeds, liens, plats and UCCs online at gsccca.org or visit our office at 75 Langley Drive, Lawrenceville GA 30046. There is a fee to access the website and a $. 50 charge for each copy printed. There is no charge to search and view documents in our office.
To look at a deed you can: Go to your Register of Deeds Office and look at the document there. Find your Register of Deeds in: Your phone book under county government. The NC Directory of State and County Officials: Look it up online. Many counties have their real property (land) records online. Go to the county website.
All deeds must be recorded with the Clerk of Superior Court. Many deeds are available online by accessing the local Clerk of Superior Court website. Others may be secured through the Georgia Superior Court Clerks Cooperative Authority at .gsccca.org.
