lets say youve got a 12 month tenancy agreement but after just three months your tenant calls you and says my circumstances have completely changed ive got to leave town i can no longer live in your property as the landlord what do you do you probably want to help them but you probably also dont want to just rip up the contract and be left without income and an empty property as ever the first thing to do is of course to consult the tenancy agreement as its likely that there may be a clause that explains exactly what both parties do its most common that that clause will say the tenant can be released early as long as another tenant is found to replace them at the property theyd be released from the tenancy at the point that the new tenancy begins ensuring that theres no void period or loss of income for the landlord since the tenant fees act came in in 2019 its also clearly acceptable for the landlord to propose that the tenant covers any reasonable costs incurred in relettin

Many tenancies end automatically if you leave by the last day of the fixed term. Some contracts continue as periodic tenancies after the fixed term unless you give notice to say youre leaving. Check your contract before the fixed term ends to see if you have to give notice and how much notice you should give.
The tenant must give 60 days notice before the last day of a tenancy year to be effective on the last day of the tenancy year. The landlord must give 90 days notice before the last day of a tenancy year to be effective on the last day of the tenancy year.
The landlord, on the other hand, can only cancel a tenants lease if the tenant has bdocHubed the lease, and if, after having given 20 business days written notice to the tenant to remedy the bdocHub, the tenant still fails to comply.
Fixed-term tenancies can only be changed if the landlord and all the tenants agree. Any agreement should be in writing and should include whats been agreed to. Both the landlord and tenants should keep a copy of this. The landlord may charge a fee for ending the fixed-term early.
If you do not give proper notice (60 days typically), your tenancy might continue for a period of time after you depart which means you could owe rent for that time, potentially then paying rent for two places.
You must provide the landlord with your notice no later than 30 days after the landlord gives you the standard lease. In either case, you must provide the landlord with a written notice to terminate the tenancy at least 60 days before the last day of a rental period.
You can end a fixed term tenancy early if you either: use a break clause in your contract. negotiate an early end to your contract. have the right to unwind your contract because you were misled.
All sections of the standard lease are mandatory and cannot be changed. When completed, the standard lease creates a contract between the landlord and tenant. This part provides more information about the rights and responsibilities of tenants and landlords under the act, starting on page nine.
