In this tutorial, Mark Trademan discusses the importance of updating ownership information for federal trademarks with the USPTO. Changes in ownership can include a change in the business name, entity type, or if the trademark has been assigned due to a sale. It’s crucial for businesses with live federal trademark applications or registrations to report these changes to the USPTO. Mark explains that ownership changes occur when there is any modification in the legal entity owning the trademark, ranging from simple changes like a name change to more complex transactions like the sale of a business. The video aims to guide viewers on how to record these changes effectively.

This identity or relationship must be valid at the time the PCT application is filed. Where a U.S. priority document is filed in the name of the inventors and the PCT application is filed in the name of the owner, there must be an assignment from the inventors to the owner prior to the filing of the PCT application.
The USPTO maintains a patent assignment database that includes all the assignments recorded since August 1980. Using the database, you can search with the assignors or assignees name, the patent number, application number, publication number, or other identifying information.
A patent transfer is usually accomplished through a contract, like the written agreement form that follows. However, after the parties have negotiated and signed their agreement, the transfer must be recorded with the U.S. Patent and Trademark Office (USPTO).
In addition to the description, the provisional application must include: all drawings necessary to understand the invention; the names of all inventors; the appropriate filing fee (approximately $125 for individual inventors); and. a cover sheet that identifies the invention.
The United States Patent and Trademark Office will accept and record only a copy of an original assignment or other document. See MPEP 317. The document submitted for recordation will not be returned to the submitter. If the copy submitted for recordation is illegible, the recorded document will be illegible.
Generally, no. Assignments are transfers of the entire interest in a patent from one entity to another. They are distinguished from licenses, which give another person a limited right to the patent. In the US, there is no requirement that an assignment be docHubd.
Using EFS-Web you can submit documents in PDF format directly to the USPTO within minutes. For the small list of documents that cannot be submitted via EFS-Web, see Legal Framework for EFS-Web. Mail via U.S. Postal Service (USPS) to: Commissioner for Patents, P.O. Box 1450, Alexandria, VA 22313-1450.
The provisional application never becomes a patent and does not need to be assigned. Thus, assignments are often only executed after a non-provisional application is filed.
Assignment of a Provisional Patent You can assign a provisional patent just like you would a nonprovisional, or utility, patent, which is one that has already been issued.
The original owner should record the assignment or name change with the USPTOs Assignment Recordation Branch by filing a Recordation Cover Sheet along with a copy of the actual assignment or proof of name change.
