Custody Modification. If you need to modify a custody or parenting time order in Oregon, you must show: an unanticipated change in circumstances regarding the other parents ability to properly care for the child/ren. that the requested modification is in the childs best interests.
Under Alabama child support law, you can modify your support order if there has been a substantial change in circumstances since the time the order was put in place, such as: Job loss, remarriage or other financial change. Relocation or another event affecting child custody and support.
Examples of Unfit Parent Behavior Child abuse. Child endangerment, such as leaving a young child home alone for long periods. Persistently engaging in criminal activity. Abandonment or desertion of the family.
Common Reasons for Modification of Custody A parent believes the child is neglected in the other parents custody. The childs needs and/or preferences have changed. The child is in immediate danger due to domestic violence, drug use, or alcoholism in the other parents home.
What should my parenting agreement contain? A parenting time schedule. Information about how the parents will make decisions for the child. Information about finances and expenses. Parenting provisions (rules about raising the child) Any other information you want to include.
There is no specific age when Alabama courts must consider a childs opinion. Instead, the judge in each case must determine whether the child is mature enough to have a reasonable preference.
An individual simply needs to petition the court for a modification of custody; as long as the other parent agrees to the change, then this can be a simple and easy process. In some cases, both parties cannot completely agree, but can agree on most changes needed to the childs custody arrangement.
Most parents choose a 2-2-3 schedule, where kids spend two days, two days, and three days with each parent in a rotating schedule. The weeks rotate so that each parent has some weeks with a larger amount of parenting time.
