Upon the death of a family member, an employee is entitled to bereavement leave of up to five days which may be taken during the period beginning on the date of death and ending six weeks after the date of the next of funeral, burial or memorial service, whichever is later.
An employee is entitled to use a total of up to 104 hours (13 days) of sick leave each leave year for family care and bereavement, which include making arrangements required by the death of a family member and attending the funeral of a family member.
When a member of an employees immediate family dies, the employee is entitled to leave on any normal working day that falls within the three-day period immediately following the day the death occurred. 2.
Employees become eligible for two weeks of paid bereavement leave if a childincluding adopted, foster and stepchildren, as well as an adult child with a mental or physical disabilitydies. Employees have one year in which they may elect to take a period of up to two weeks of paid leave.
Employers in California are required to offer five days off, either paid or unpaid, for mourning the loss of a loved one. If it is unpaid, employees are allowed to charge the time to paid sick leave, vacation time, or other accrued time off.
AB 1949 provides eligible employees with up to five days of bereavement leave upon the death of a qualifying family member. The five days of bereavement leave provided under AB 1949 are separate and distinct from the 12 weeks of leave permitted under CFRA it is an additional form of protected leave.
The employer may require that the employee provide documentation of the death of the family member including a death certificate, published obituary, or written verification of death, burial, or memorial services from a mortuary, funeral home, burial society, crematorium, religious institution, or governmental agency.
The bereavement leave category is available to federal employees serving in permanent or term appointments of more than one year with at least one year of service. Employees with intermittent work schedules are not eligible, and seasonal employees cannot use leave during their off-season.
