An advance directive is a legally binding document that provides the adults written instructions, made while capable, directly to their health care provider, for the health care they wish to consent to or refuse when incapable.
In NSW, there are no statutory advance care directives. Only common law advance care directives exist and are legally binding. These can include a persons values, preferences for future treatment (consent to, refusal of and/or withdrawal of treatment) and appointment of a substitute decision-maker.
These include: Living Will. A living will is a written document that specifies what medical treatment you would or would not want in the event you are in a terminal condition or a persistent vegetative state. Power of Attorney. Health Care Instructions.
Advance care planning is not the same as an advance directive. Advance directives often include explicit instructions to consent or withhold consent to treatment in specific circumstances. They may also serve to formally assign a substitute decision-maker in the event the patient becomes incapacitated.
An Advance Medical Directive (AMD) is a legal document that you sign in advance to inform the doctor treating you (in the event you become terminally ill and unconscious) that you do not want any extraordinary life-sustaining treatment to be used to prolong your life. Making an AMD is a voluntary decision.
If a patient is capable, under Ontario law the physician must never rely on an advance directive (unless it is an emergency and the capable patient cannot communicate). The health practitioner must instead speak directly with the patient to obtain consent.
You can only make an advance directive while you are competent; nobody else can make an advance directive for you. Competent in this case means able to make important decisions for yourself. The advance directive only takes effect if you stop being competent.
Important note: In Ontario, there is no legislation specifically about Advance Directives (AD) like there is in some other provinces so there is no legal definition of AD. Instead, the language used by the Ontario Health Care Consent Act, 1996 is wishes with respect to treatment.
