Zero-reject prohibits schools from excluding any student with a disability from a free APPROPIATE public education (FAPE). This applies to children/students age 3-21; no matter how severe their disability.
The federal regulations for IDEA 2004 include a section (Subpart E) called Procedural Safeguards. These safeguards are designed to protect the rights of parents and their child with a disability and, at the same time, give families and school systems several mechanisms by which to resolve their disputes.
If a parent refuses to consent to the evaluation, the school may pursue consent through mediation or the due process system. Consent to evaluate does not constitute consent to provide services.
What are procedural safeguards? Procedural safeguards aprotect the rights of children with disabilities and their parents. These safeguards include the right to participate in all meetings, to examine all educational records, and to obtain an independent educational evaluation (IEE) of the child.
In 1975, the Education for all Handicapped Children Act, now called the Individuals with Disabilities Education Act (IDEA), codified the right to a free, appropriate public education for all students, including those with severe disabilities.
The students IEP must be reviewed and revised within 30 calendar days of the completion of the RR.
Section 504 requires districts to provide notice to parents explaining any evaluation and placement decisions affecting their children and explaining the parents right to review educational records and appeal any decision regarding evaluation and placement through an impartial hearing.
10 Evaluation Takeaways for Parents In your request, ask that your school evaluate your child for special education services. Address your written request to your schools principal and your districts special education director. Your school district has 15 school days to respond to your request, in writing.
An independent educational evaluation at public expense must be completed within 30 days of a parent written request unless the school district initiates an impartial due process hearing or the parent or school district offers reasonable grounds to show that such 30-day time period should be extended.
This would be an additional evaluation at no cost to the parent or adult child. If the parent or adult child would like to request an IEE the request should be put into writing and given to the school. The school then has 30 calendar days to respond in writing to the IEE request.
