If both parents do not consent to the name change, then you may ask the court to decide. You need to show the court that the name change is in the childs best interests, and that the circumstances of your case are extreme.
However, if someone has contested the name change, or if the judge has any questions about your Petition, he/she may schedule a hearing. All of these steps are discussed further below.
