A quick recap: You can start using your new name as soon as youre married. You will need a certified copy of your marriage certificate to have your name changed on legal documents. And if you are getting a divorce, you can ask the court to restore your former name in a divorce proceeding.
Minors who are at least 10 years old, can use Minors Consent/Objection to Change of Name form (CC-DR-119). Parents, guardians, and custodians can use Parents/Guardians/Custodians Consent/Objection to Change of Name of a Minor (CC-DR-063).
You will need to pay a filing fee at the time of submitting the forms. (This varies from around $70 to $200. For reference, the fee in St. Marys County is $135.)
Your marriage certificate is a record of your marriage, not your new name or your title. Just because you marry doesnt mean that you automatically take a husbands name or that you are now a Mrs. You have the right to choose the name you want.
You may obtain a Rescission Form by calling the Maryland Department of Healths Division of Vital Records at 410-764-3182. If it has been more than sixty (60) days since you signed the Affidavit, the Rescission Form will NOT be effective. After the sixty (60) days, the Affidavit can only be nullified by a court order.
To ask the court for a name change, you need to file a petition. You can use the Petition for Change of Name of an Adult (CC-DR-60) or Petition for Change of Name of a Minor (CC-DR-062). Attach documents with your or the minors current name (birth certificate, drivers license, passport, etc.).
If you were married in Maryland, you can request a new marriage record that reflects your new name by filing a Request for New Marriage Record (CC-FM-072) in the circuit court of the county that issued the record.
