if youamp;#39;re selling your property and you receive an offer from a buyer with a home sale contingency I would suggest countering that buyer with a kick out clause as a seller a kickout clause is beneficial to you because youamp;#39;re allowed to accept the primary contract with a kickout clause your listing will be active on the MLS and youamp;#39;re still showing the property and youamp;#39;re trying to solicit bona fide backup offers that are subject to the termination of that primary contract that you previously accepted upon accepting this backup offer thatamp;#39;s subject to the termination of the primary you then have to go back to the primary contract and give those buyers two options option one those buyers can kick themselves out of the contract they can take their escrow deposit and continue their search option two those buyers want to stay engaged and buy that house so they need to put down an additional deposit release all contingencies that are related to inspect

The Kick-Out clause allows sellers to continue looking for buyers, even after they have accepted a contingent offer from a buyer. This is especially useful in a competitive market where sellers may receive multiple offers, as the clause gives them the flexibility to accept a better offer if one comes along.
The escape clause, typically 24 or 48hrs means that if while conditionally sold, if the seller receives a new offer from a second buyer that they like better than the original offer, theyre giving the current buyer 24 or 48-hour clause to remove ALL conditions (more about this below) or walk away from the deal.
a clause that permits signatories to a contract to opt out of particular provisions, or to terminate the contract early.
It applies when someone has made a contingent offer to buy the house. The kick-out clause says that the seller can continue showing the home and can accept a new offer that comes without contingencies, effectively kicking out the contingent offer if a stronger one comes along.
Alterations on the Contract (or Strikethroughs) You simply cross out the language that no longer applies and re-write the language that should be applicable. Just be sure that each party initials or creates a written agreement that reflects that they approve the changes to avoid disputes down the road.
Also called a release clause, the 72-hour clause is typically written into sales contracts by the seller. With a 72-hour clause in the contract, a seller is able to keep the home on the market and accept backup offers on the property.
A kick-out clause allows the seller to continue listing the house for sale. If the buyer does sell the house during that time, the buyer closes title on the sellers house. However, the seller is not hurt if the buyer does not sell the home because the seller was able to continue showing the home.
In a nutshell, contingent with no kick-out means an offer has been accepted on the house and the seller cannot accept another buyers offer unless certain requirements are not satisfied.
