Therefore, if you decide to make changes to your logo, it is recommended to file a new application. This way, you will gain protection over your new logo so no third party can use it. If your application passes, you will own two separate trademarks - one for your old logo and the other for the new one.
How Do I Amend a Trademark Registration? If your trademark registration is not the subject of a cancellation proceeding, then you can amend your trademark registration by filing a Section 7 Request for Amendment with the USPTO. The Section 7 is an online form that is available on the USPTOs website.
Copyright protects the artistic elements of a logo, such as graphic design, color schemes, and typographic styles. When altering your logo, you must either own the rights to the original design or have permission from the copyright holder to make changes.
