If you want rights to an abandoned trademark, the best action is to obtain a federal registration with the USPTO. You can do this by filing an online application on the USPTOs website, which includes your contact information, a drawing of your mark, a description of the associated goods or services and a filing fee.
If you find an error in your filing receipt immediately after submitting your form, contact the Trademark Assistance Center. If your error is not correctable, you may need to file a new application. However, your filing fee will not be refunded. The filing fee is a fee for processing your application.
You must file these documents within these deadlines to keep your trademark registration alive: Between the fifth and sixth years after the registration date. Between the ninth and 10th years after the registration date. Every 10 years after that (between the 19th and 20th years, 29th and 30th years, etc.)
Should an application fall into an abandoned status at any time during the registration process, a petition fee of $150 is required to revive and resume prosecution of the application.
When a trademark is abandoned, the trademark owner may no longer claim rights to the trademark. In effect, this frees the trademark so that anyone else can use it without recourse from the original trademark owner.
Should an application fall into an abandoned status at any time during the registration process, a petition fee of $150 is required to revive and resume prosecution of the application.
This case involves rectification, which is an equitable remedy which corrects a document to reflect the parties contractual intentions. Grounds for rectification include common mistake and unilateral mistake.
You can request to change some information in your trademark application after your examining attorney approves your trademark for publication and before your trademark is registered. However, not all changes are allowed.
If a trademark applicant unintentionally fails to respond to an Office Action or to a Notice of Allowance, there is a mechanism in place for that applicant to revive the trademark application. If this occurs a petition to revive the application must be filed with the United States Patent Trademark Office (USPTO).
If your application is abandoned but you still want to pursue a trademark registration, you may be able to revive your application by filing a petition.
