So lets say youve just submitted a trademark application with the United States patent and trademark office. After you submit it, you realize, oh shoot I made a mistake. You must file these documents within these deadlines to keep your trademark registration alive: Between the fifth and sixth years after the registration date. Between the ninth and 10th years after the registration date. Every 10 years after that (between the 19th and 20th years, 29th and 30th years, etc.)
These errors are recorded in the trademark register, after its registration. This can happen if mark may have been wrongfully registered or still have remained in register even after its expiry. If your trademark registration is not the subject of a cancellation proceeding, then you can amend your trademark registration by filing a Section 7 Request for Amendment with the USPTO. The Section 7 is an online form that is available on the USPTOs website.
Unlike patents and copyrights, trademarks do not expire after a set period of time. Trademarks will persist so long as the owner continues to use the trademark. Once the United States Patent and Trademark Office (USPTO), grants a registered trademark, the owner must continue to use the trademark in ordinary commerce.
