You must file these documents within these deadlines to keep your trademark registration alive: Between the fifth and sixth years after the registration date. Between the ninth and 10th years after the registration date. Every 10 years after that (between the 19th and 20th years, 29th and 30th years, etc.)
If it cant be processed in time, your trademark will be published as is. However, after your trademark is registered, you can request changes by filing a Section 7 Request for Amendment or Correction of Registration Certificate form.
Under the Lanham Act, any party who may be damaged by the actual or proposed registration of a mark is entitled to challenge the registration. If the mark has been published for proposed registration on the Principal Register, the partyusually the owner of a competing markcan oppose the registration.
Should an application fall into an abandoned status at any time during the registration process, a petition fee of $150 is required to revive and resume prosecution of the application.
You may challenge an application for trademark registration at the USPTO by filing an opposition with the TTAB within 30 days after it is published in the Official Gazette.
You must submit a properly signed response either within 30 days from the date the notice issues, or within the time remaining in the response periodthe notice will specify the deadline. If you file a response after the deadline, the application will be abandoned.
Publication begins a 30-day period during which any member of the public who thinks theyll be harmed by the registration of your trademark may oppose it. They may file a Notice of Opposition, which starts a legal proceeding with the Trademark Trial and Appeal Board (TTAB) about your trademark.
