Employers laying off workers employed in Wisconsin should be aware that federal and/or state law may require that written notice be provided 60 days in advance of a dislocation event. Employers must comply with both laws if they both apply. Sample letters are provided to help with this process.
1. Plant Closure: The California WARN Act applies when there is a plant closure affecting any number of employees. 2. Mass Layoff: A layoff of 50 or more employees within a 30-day period triggers the Act, regardless of the percentage of the workforce.
Employers must give a WARN notice at least 60 calendar days before any planned plant closure or mass layoff. If all employees are not terminated on the same date, the date of the first individual termination within a 30-day or 90-day period starts the 60-day notice requirement.
WARN Notices in Wisconsin The WARN Act states that employers have to give Wisconsin employees 60 days notice when initiating a mass layoff. If any of those employees belong to a union, then the union representatives have to be notified instead of the individual employees.
WARN notices must be given at least 60 calendar days before any plant closing or mass layoff, and an employer may not order a plant closing or mass layoff until the 60 day time period has expired. There are, however, a few exceptions to this general rule.
