A Business Associate Contract, or Business Associate Agreement, is a written arrangement that specifies each partys responsibilities when it comes to PHI. HIPAA requires Covered Entities to only work with Business Associates who assure complete protection of PHI.
Examples of Business Associates are lawyers, accountants, IT contractors, billing companies, cloud storage services, email encryption services, web hosts, etc.
(b) Termination for Cause. Business associate authorizes termination of this Agreement by covered entity, if covered entity determines business associate has violated a material term of the Agreement [and business associate has not cured the bdocHub or ended the violation within the time specified by covered entity].
Where a covered entity knows of a material bdocHub or violation by the business associate of the contract or agreement, the covered entity is required to take reasonable steps to cure the bdocHub or end the violation, and if such steps are unsuccessful, to terminate the contract or arrangement.
HIPAA defines businesses associates as a person or entity that provides services to a covered entity that involves the disclosure of PHI. Businesses that would be considered business associates when working with covered entities are: Software companies with access to PHI. Companies in claims processing or collections.
Individual Notice: Covered Entities must notify, in writing via first-class mail or email, any affected individuals following the discovery of a bdocHub of Unsecured PHI. Notifications must be provided without unreasonable delay and in no case later than 60 days following the discovery of a BdocHub.
Yes. A covered entity is responsible for the noncompliance of its business associate where the business associate does not comply with an applicable HIPAA Administrative Simplification requirement.
At its most basic, BAAs must contain these provisions: Determine what PHI the Business Associate will access. Require that the Business Associate will use appropriate safeguards to secure PHI. Provide that the BA will not disclose protected health information save when permitted by the agreement.
HIPAA bdocHubes include unauthorized access by employees as well as third parties, improper disclosures, the exposure of protected health information, and ransomware attacks.
The most common patient confidentiality bdocHubes fall into two categories: employee mistakes and unsecured access to PHI.
