You must give Form W-8BEN-E to the withholding agent or payer if you are a foreign entity receiving a withholdable payment from a withholding agent, receiving a payment subject to chapter 3 withholding, or if you are an entity maintaining an account with an FFI requesting this form.
Entities must use Form W-8BEN-E. ▶ Go to .irs.gov/FormW8BEN for instructions and the latest information. ▶ Give this form to the withholding agent or payer.
Submit Form W-8BEN when requested by the withholding agent or payer whether or not you are claiming a reduced rate of, or exemption from, withholding. You are a U.S. citizen (even if you reside outside the United States) or other U.S. person (including a resident alien individual).
Generally, a U.S. Green Card holder cannot provide Form W-8BEN, and must provide Form W-9 instead. If you did formally renounce your US Green Card, please provide a copy of your Form I-407 (Record of Abandonment of Lawful Permanent Resident Status).
The W-8BEN is filed with the withholding agent, so there is no need to mail a copy to the IRS. Generally, your W-8BEN will remain in effect for three years, unless a change in circumstances makes any information on the form incorrect.
Give Form W-8 BEN to the withholding agent or payer if you are a foreign person and you are the beneficial owner of an amount subject to withholding. Submit Form W-8 BEN when requested by the withholding agent or payer whether or not you are claiming a reduced rate of, or exemption from, withholding.
The first time you make a US trade online, youll be prompted to complete a W-8BEN form. Your W-8BEN needs to be renewed every three years, and well always let you know when its time. If youre a non-US citizen you can submit or update your W-8BEN online: Log in to your account.
Youre required to submit a properly completed Form W-8BEN to the party or company thats providing you with income if youre a Canadian contractor earning income from a U.S. source.
