A postnuptial agreement or postnup, is similar to a prenuptial agreement, but the former legal contract is written and signed after a couple is legally wed. A postnup contract outlines how assets will be divided in the event of a divorce.
Creating a postnuptial agreement has no time limit. As long as your agreement fulfills Californias legal requirements, the courts will consider it valid no matter how long you have been married.
Postnuptial contracts are only enforceable if they are in writing and signed by both parties, with witnesses present.
Any indication of coercion,fraud, deception, threat, or physical force makes the agreement null and void. It must be fair. A postnuptial agreement cannot be unfair or unconscionable, meaning blatantly one-sided or otherwise unjust toward one spouse when considering the facts and circumstances of the relationship.
A postnuptial agreement cannot provide enforceable terms for child support or custody. However, it can include provisions for alimony since that is considered separately from a spouses duties as a parent.
Possible cons of postnuptial agreements include: Potential for creating mistrust or tension in the relationship. Emotional stress during negotiation. Limitations on future financial flexibility. Invalidation risks due to improper drafting or execution.
Fortunately, there is not a deadline of any sort for creating a postnuptial agreement. While it is typically recommended to draft one soon after marriage, it can spouses can initiate an agreement at any point during the marriage.
Before proceeding with a postnup, its also worth keeping in mind that these agreements are easier to enforce in some states than in others. Most courts tend to uphold the agreements as long as theyre written, signed without coercion, and involve a full disclosure of financial information on both sides.
