You must give the tenant the Notice of Rent Increase at least 90 days before the date you will increase the tenants rent.
In response to your notice of rent increase and modification of another condition of the lease, I hereby inform you that (check off ONE of the boxes below): I accept the renewal of the lease with the modifications. I refuse the proposed modifications and am renewing the lease.
Ontario is a rent-controlled province for the most part, with a few exceptions. This means that a landlord can only increase your rent by a limited amount each year. Newer buildings are not rent controlled and landlords do not need to follow the same guidelines.
Here is an example of a letter to respond to a rent increase: Dear [Landlords Name], I am writing this letter to confirm my agreement of the rent increase from [current rent amount] to [new rent amount] as of [date of rent increase]. I understand the need for this increase and agree to pay the new amount.
In addition to inflationary (guideline) rent increases, the law in Ontario also allows landlords to apply for Above Guideline Rent Increases or AGIs. Landlords are able to apply for a host of reasons including: Major capital work has been paid for and finished (balconies, elevators)
You can apply the LTB to get your money back at tribunalsontario.ca/ltb. You must apply within one year of the date that your landlord first charged you the illegal rent. CLEOs T1 Guided Pathway can help you fill out the forms you need to apply.
Can a landlord remodel while occupied? Yes, and if the work that needs to be done is not overly disruptive or is just a few minor upgrades, then your tenant can stay put.
