In order to remove lap marks from a stained surface, you can soak a clean cloth in paint thinner and rub the cloth over the dark areas of the lap marks. As a result, the lap marks will slowly begin to disappear and remove some of the stain.
Sand the entire deck to remove any old stain, paint, or varnish from the wood. After sanding, power-wash the deck and allow it to dry for at least 24 hours before staining. Sanding exposes porous wood that's ready to soak up the stain, but this isn't possible if the wood is full of water.

Can I stain on top of old stain? Yes! In fact, applying stain over stain is a fairly simple process. It works especially well if you're applying a dark stain over a lighter stain.

Just clean the surface thoroughly using a good quality decking cleaner, which will get rid of the dirt, then re-oil it. 2-3 coats should do the trick.
The ideal way to fix a wood stain mistake is to sand the piece down to bare wood, and re-stain. However, this is time-consuming. Applying another layer of stain, painting the piece, or evening the piece with gel stain are other methods that could produce a satisfactory result.
When in Doubt, Strip Away the Old Stain. Generally speaking, it's a good idea to completely remove all traces of the previous coat of deck stain before applying a new one. The reasons for this may be fairly obvious -- a previous coat of stain might be peeling away from the surface in several areas.
Give it a few more days to see if it improves. Another possibility is that the stain was old or came from a bad batch. In either case if the tackiness doesn't go away, wipe the wood down with mineral spirits or naphtha to remove most of the stain, let it dry thoroughly, then try again using a fresh can of stain.
