A: It depends on the terms of the severance package. Some employers might let you keep anything youve been paid under the severance plan if you are rehired at a later date. Some employers might make you repay all or part of any money you received if youre rehired within a certain amount of time.
While it is unusual for an employer to withdraw a severance offer, it is important to understand that the offer may be rescinded, even if it is covered by the OWBPA. Employers need to be cognizant of their rights in the event of bad behavior by the employee before the agreement is signed.
The answer is yes and no. Usually, you get severance pay if you get terminated. But if you get fired for job related wilful misconduct then you may not receive any severance. In some cases, you get severance after a prolonged laid off period or when contract was silent on layoff.
A non-union employer, faced with a plant closing, may be even more abrupt. Such an employer, under no obligation to bargain with its workers about employment terms, may simply choose to take a unilateral action to alter or eliminate a severance pay plan or practice.
With any form of severance pay, the best-case scenario is to replace your employment as quickly as possible so that you do not need to rely on the severance income to live.
If you are being offered severance, the company wants your cooperation, which means you have leverage. Just like you should not accept any initial offer when negotiating a job salary, you should never accept what is initially offered in a severance package.
Just as your employer typically does not have to offer you any severance, your employer can withdraw an offer if you do not accept it before it is withdrawn.
It would be highly irregular for an employer to pull an initial severance offer like that. You could always counter the offer though and try to negotiate for more, but the initial offer is likely what you are entitled to as far as severance under BC law in ance with your employment agreement.
