You can ask the court to stop the bailiffs if you have an eviction date. There are 2 steps to this process: Complete Form N244 and return it to the court. Attend a short hearing where the judge makes a decision.For example: letters about benefits. a job offer from an employer. bank statements showing recent payments.
You may be able to ask the court to suspend the warrant or postpone the date for eviction. Some lenders use high court enforcement officers (HCEOs) to carry out an eviction. These are private bailiffs who are authorised by the high court. The process can be quicker.
Bring with you a copy of the warrant for removal. Tell them you want to apply to have your eviction stayed (or stopped). They will ask you to complete a form and, on the form, you will be able to list the reasons you need the stay. After you file the papers, the court will make a decision about what to do.
In general, the courts expect landlords to complete all safety-related repairs within 30 days or less. If a landlord fails to act within a reasonable amount of time, the tenant can apply to the court to commence the escrow process.
The tenant has three (3) business days to move all persons and belongings from the premises. If the tenant does not move after three (3) business days from the time the warrant for possession was served on the tenant, the landlord may arrange for the Court Officer to have the tenant evicted or locked out.
Third, the landlord must have a reasonable amount of time to fix the problem. It is presumed that within 30 days of the landlord receiving notice is a reasonable amount of time.
Talk to Your Landlord You may be able to come to an agreement without going to court. An eviction will cost both of you money (as well as time), and your landlord may be willing to stop the eviction if you agree to certain terms, such as paying rent you owe or stopping behavior that violates the lease.
They can request a hardship stay. This could stop the eviction for up to six months. Tenants cannot apply for a hardship stay unless they pay all the money they owe to the landlord, plus any costs.
