How can you revive a canceled trademark registration? The USPTO will usually send a notice of cancellation or expiration. Within two months of the date of the cancellation/expiration notice, the registration owner must file a petition to revive with all the necessary requirements and fees.
Refile the trademark application In the event your trademark was abandoned you can always start the process over again by refiling the trademark. Refiling your trademark will require you to pay the processing fees again as if you are doing it for the first time.
A dead or abandoned status for a trademark application means that specific application is no longer under prosecution within the USPTO, and would not be used as a bar against your filing. While you can register a dead mark, other potential issues may make it not worth the risk.
Unlike patents and copyrights, trademarks do not expire after a set period of time. Trademarks will persist so long as the owner continues to use the trademark. Once the United States Patent and Trademark Office (USPTO), grants a registered trademark, the owner must continue to use the trademark in ordinary commerce.
You can modify the trademark youre using on your products and services, but you cannot modify an existing registration, so unless you register your newly modified trademark, it will not have the same scope of protection as a prior, unmodified, registered trademark.
If your application is abandoned but you still want to pursue a trademark registration, you may be able to revive your application by filing a petition.
What if the second application for the same mark has some overlapping goods or services? If the second application identifies some goods or services that overlap with a first application, but also contains some different goods or services, the second filing would not result in a duplicate registration.
If a trademark has been removed from the Register of trademarks on the grounds of non-renewal then the same can be restored by filing an application in the prescribed form for restoration of the mark after six months and within one year from the date of expiration of the last registration of the mark.
