A witness can usually be anyone, however, certain documents will need an authorised person to witness it. A statutory declaration is one such example as it needs to be witnessed by someone like a justice of peace.
To be validly executed as a deed, each individual must sign the document in the physical presence of a witness. The witness must be an independent person such as a friend, neighbour or work colleague. They cannot be a relative, nor be another party to the deed.
Any individual over the age of 18 who possesses sufficient maturity can act as a witness. However, the witness should not have any personal interest in the mortgage deed or be a family member. It is important that the witness is independent and free from any potential conflicts of interest.
Obtaining a Lien Release Once you have paid off your loan, the lien should be removed by removing the lender from your Certificate of Title. Typically, once you pay off your loan, the lender signs the back of the Certificate of Title to release the title to you.
Submit the deed, along with the necessary supporting documents, to the local sub-registrar office in the jurisdiction where the property is located. Pay the applicable stamp duty and registration fees. The sub-registrar will review the documents, and upon approval, the Deed of Reconveyance will be registered.
An independent witness is someone who is not any of the following. a member of your family; under 18; named elsewhere in the document (other than as a witness to someone elses signature); named elsewhere in the other documents connected with your document (other than as a witness to someone elses signature);
The mortgage deed is the document that states that you and the lender have agreed to use the property as a security to protect the mortgage. The deed contains information on the conditions of the mortgage, repayment schedule, length of the mortgage, mortgage rates, type of mortgage and security for the mortgage.
Generally the person you choose to witness a document should have no financial or other interest in an agreement. A neutral third party is the best choice. A neutral third party is someone not related to either party and who does not benefit from the contract.
