Its illegal in Maryland for a landlord to retaliate and evict a tenant primarily because the tenant or a housing inspector sends a notice to the landlord informing them that there are lead hazards in the property or that there is a child with an elevated blood lead level living in the property.
Landlords are required to give tenants sixty (60) days notice before the lease officially ends. In contrast, tenants are only obligated to notify their landlord thirty (30) days before they intend to terminate the lease.
Under current state law, landlords may utilize the Tenant Holding Over (THO) eviction action in District Court, under Real Property 8-402, after expiration of the lease. This statewide statute does not require a landlord to demonstrate any reason for the decision to terminate or non-renew the lease.
A notice to vacate from your landlord is not a court order. This is the written notice that a landlord must give you at least one month before your lease ends if they want you to move out at the end of the lease. If you do not move out, your landlord must go to court to try to evict you.
Notice to Vacate - Non-Renewal of Lease If a landlord does not want to renew a tenants lease, the landlord must provide a 60-day notice to vacate. This requirement applied to month-to-month leases, long term leases, multifamily and/or single family rentals.
A - No. The law does not give you time to change your mind. (Maryland law allowing for a three day contract cancellation period only covers activities of door-to-door salespeople, health club memberships and certain credit transactions.) Q - The landlord and I signed the lease, but I havent moved in yet.
A landlord may give a written 30-day bdocHub of lease and intent to terminate tenancy notice that states the alleged violation of the lease at any time during the tenancy. The landlord can give this written 30-day bdocHub notice immediately upon discovery of the bdocHub.
