An affidavit of heirship is a document, sworn to under oath, that is submitted to the Surrogates Court definitively identifying all of the people who may have a legal claim to inherit the decedents assets or property.
Under New York law, the distributees are determined in the following order: Spouse and children. If a decedent leaves a spouse and children, the spouse and children are considered distributees. However, if there is only a spouse and no children, the spouse is the sole distributee.
Filing an affidavit of heirship can allow the title of real estate to be transferred from the deceased partys name to the names of the heirs without going through the probate process. This will provide a clean chain of title transfer and is far less costly and time-consuming than probate.
