30-day letter (Notice to Quit) for contractual issues. This notice applies if the tenant is in violation of the lease/rental agreement. The landlord gives the tenant written notice to vacate the premises within 30 days.
If you do not have all the money thats owed, you may be able to prevent the eviction by getting a written commitment from a local government or nonprofit agency to pay the rent due, plus late charges, attorney fees, and court costs within 10 days of the first date set to appear in court (called the return date).
If you do not leave at the end of the notice period, your landlord must apply to the court for a possession order. If the court gives them a possession order and you still do not leave, they must apply for a warrant for possession - this means bailiffs can evict you from the property.
It takes about 5 to 30 days from the issuance of the Notice to Quit, depending on the reason for eviction and the lease agreement.
The Writ of Eviction is issued 10 days after the landlord wins the case. It is delivered to the tenant 15-30 days once received by the law enforcement officials. Tenants then have 72 hours to vacate the property.
Month-to-Month Tenancy If the tenant has not moved out of the rental unit by the end of the 30 days, then the landlord can file an eviction lawsuit against the tenant. (Va. Code Ann. 55.1-1253A (2020).)
If the tenant wishes to contest the eviction, the judge will schedule a trial date. Otherwise, the landlord will be granted judgment and a Writ of Possession may be issued the same day.
If a landlord wants to evict you for not paying rent, the landlord must give you a written notice to either move or pay rent in 5 days. This is sometimes called a pay or quit notice. If you pay the rent in 5 days, you get to stay.
