Under an Arizona statute governing contract disputes, A.R.S. 12-341.01, the court may award the prevailing party reasonable attorney fees in any contested action arising out of a contract.
12-341.01 - Recovery of attorney fees. A. In any contested action arising out of a contract, express or implied, the court may award the successful party reasonable attorney fees.
The attorneys fees law in California generally provides that unless the fees are provided for by statute or by contract they are not recoverable. In other words, unless a law or contract says otherwise the winning and losing party to lawsuit must pay their own attorneys fees.
In a contingent fee arrangement, the lawyer agrees to accept a fixed percentage (often one-third to 40 percent) of the recovery, which is the amount finally paid to the client. If you win the case, the lawyers fee comes out of the money awarded to you.
